The elements of fraud: What the prosecutor must prove in a fraud case

The burden of proof in a fraud case lies with the prosecuting attorney. All of the following elements must be proven beyond a reasonable doubt to secure a conviction:

Intent to deceive

It must be proven that the accused had the intention to deceive or defraud another party. 

False representation or concealment

The case must include a false statement, representation, or concealment of material facts by the defendant. These statements could be in several forms, including verbal statements, written documents, or omissions of important facts.

Reliance

It must be proven that another person or entity relied on false representation or concealment and, in so doing, experienced financial or other losses. 

Materiality

The false statement or concealment must be material, meaning that it is significant enough to influence the decisions or actions of the alleged victim. 

Harm or loss

The alleged victim must prove that actual harm or financial loss occurred due to the actions of the accused. The types of harm can include monetary losses, reputation damage, or even emotional damage.

Causation

A direct causal link must be established between the alleged fraudulent conduct and the harm suffered by the victim and proven to be the primary cause of the harm.
